NOTIFICATION
The 24th January, 2023

PUNJAB   STATE  SAND   and  GRAVEL   MINING    POLICY,   2023

No. PB/POLICY/2023/349.-  With the objective to bring  down the prices of sand and gravel in the State of Punjab, the Punjab State Sand and Gravel Mining Policy, 2023 is hereby notified under Punjab Minor Mineral Rules, 2013 framed under section 15 and section 23C of Mines and Minerals (Development and Regulation) Act, 1957, as under:-

The Punjab State Sand and Gravel Mining Policy, 2023.

1. (1) This policy  may be called the Punjab State Sand and Gravel Mining Policy, 2023.
    (2) This policy  shall come into force with immediate effect.

2. The para 2 (i), 2(ii) and 2(vii) of mining  policy dated 24.08.2022 are hereby repealed and the Royalty and other rates are reinstated as per the policy notification dated 10.11.2021. i.e Rate of Royalty is Rs 0.73/cft, DMF  at Rs 0.20/cft and EMF  at Rs 0.07/cft along with  other charges.

3. The para 2 (viii) of mining  policy dated 24.08.2022 is hereby amended as under:-

                 “State Govt. shall collect  Royalty  and penalty amount from all the vehicles carrying processed or unprocessed minor minerals, which do not possess requisite documents, across the interstate borders into the State of Punjab provided that the sum collected from each vehicle shall not be less than the total sale price cap fixed  for sale of sand or gravel, as the case may be, at the pit head. The Chief Minister  shall  approve the rate, from  time to  time, at which  the sum is  to be collected.  Further, confirmation  receipt  in  a form  prescribed by  the govt.  shall  be issued immediately  to  all such vehicles. ”

4. The Director  Mining   is hereby authorized  to  review  the termination  of  any Agreement  arising  as a result of–
                 A.      Failure  of the  Concessionaire to execute a fresh agreement in line with  the  revised Policy dated 24.08.2022 in which  case no penalty shall be imposed, nor any dues recovered, for the period between 24.08.22 till the notification of this present policy when no mining was permitted as a result of  widespread failure to execute fresh agreements.
                B. Failure of the Concessionaire to deposit any installment/ dues in which case the contractor will have to deposit all his dues till date, but no penalty shall be imposed, nor any dues recovered, for the period between 24.08.22 till  the notification of this present policy when no mining was  permitted as a result of widespread failure to execute fresh agreements.

5. The Policy dated 24.08.2022 stands amended to the extent as mentioned above.
