Punjab Government Amends Seniority Rules: Merit-Based Ranking to Decide Inter-Se Seniority

The amendment has been made under the powers conferred by Article 309 of the Constitution of India, enabling the Governor of Punjab to modify service rules governing state employees.

The amendment inserts a new provision in Rule 8 of the Punjab Civil Services Rules, 1994.

According to the newly added proviso:

When the age of persons recruited by direct appointment in the same cadre, or by transfer from different cadres, is the same, their inter-se seniority shall be determined on the basis of merit. 2. ਹੁਣ ਉਕਤ ਵਿਧੀ ਨੂੰ ਸੁਖਾਲਾ ਕਰਨ ਲਈ THRMS ਅਤੇ IFMS ਦੀ ਇੰਨਟੀਗ੍ਰੇਸ਼ਨ ਮੁਕੰਮਲ ਕੀਤੀ ਜਾ ਚੁੱਕੀ ਹੈ। । ਇਸ ਲਈ ਭਵਿੱਖ ਵਿਚ IFMS ਵਿਚ PRAN ਨੂੰ Deactivate ਸਬੰਧੀ Ticket Raise ਕਰਨ ਦੀ ਲੋੜ ਨਹੀ ਹੋਵੇਗੀ। ਉਕਤ ਸਬੰਧੀ ਸਮੂਹ ਸਬੰਧਤਾਂ ਨੂੰ ਜਾਣੂ ਕਰਵਾਉਣ ਦੀ ਖੇਚਲ ਕੀਤੀ ਜਾਵੇ ਜੀ।

DEPARTMENT OF FINANCE (FINANCE PERSONNEL-1 BRANCH) 

NOTIFICATION 

The 24th November, 2025 

No. 09/02/2021-5FP1/100.-In exercise of the powers conferred by the proviso to Article 309 read with clause (3) of Article 187 of the Constitution of India, and all other powers enabling him in this behalf, the Governor of Punjab, is pleased to make the following rules further to amend the Punjab Civil Services (Revised Pay) Rules, 2021, namely:- 

RULES 

1. (1) These rules may be called Punjab Civil Services (Revised Pay) Second Amendment, Rules, 2025. (2) They shall be deemed to have come into force on and with effect from the first day of January, 2016. 

2. In the Punjab Civil Services (Revised Pay) Rules, 2021(hereinafter referred to as the said rules), in rule 7(I), at the end, the following provisos shall be added, namely:- 

            "Provided that in case where a Government employee has been placed in higher pay scale between 01.01.2016 to 20.09.2021 on account of promotion, such Government employee shall have the option to switch over to the revised pay structure from the date of his/her promotion:

              Provided further that the Government employee who opts to switch over to the revised pay structure from the date of promotion, such Government employee shall be entitled to get the benefit of minimum increase of 15% (Basic pay +113% DA + minimum 15% increase) on the pay fixed on the promotional post. In these cases, he/ she shall have to forgo the claims of arrears during the period from 01.01.2016 till the date of promotion and arrear of minimum increase of 15% shall also not admissible up to 20.09.2021: 

                Provided further that the Government employee who got more than one promotion during the period 01.01.2016 to 20.09.2021 has the option to switch over to the revised pay structure from the date of his first promotion only. In these cases, the next annual increment shall accrue after completing the qualifying service of twelve months".

3. In the said rules, in rule 7(II) in clause(c) sub-clause (iv) shall be substituted as under:- 

"(i) In case of the Government employees on whom instructions dated 15.01.2015 w.r.t. admissibility of Minimum of the Pay Band are applicable:- During probation period, the Government employee shall be paid fixed emoluments in the unrevised pay scales/ DC Rates as he/she is/was getting as per the instructions dated 21.12.2015 issued by the Department of Finance. His/her pay shall be fixed in the revised pay structure only after successful clearance of the probation period after applying the multiply factor(s). The Government employee will not get any arrears of the probation period: 

             "Provided that the Punjab Civil Services (Revised Pay) First Amendment Rules, 2021 shall also be applicable to the Government employees recruited between 01.01.2016 to 16.07.2020, with the following conditions, namely:- 

              (i) Pay of the Government employee recruited on or after 01.01.2016 and upto 16.07.2020 shall not, in any case, be more than his immediate senior Government employee in the cadre. If such a situation arises, then the pay of the junior employee shall be fixed at the same level as the senior. Wrong fixation of pay, in any case, under the cover of extending minimum 15% (fifteen percent) raise shall entail recovery from the salary of the concerned Government employee on its detection at any stage; 

               (ii) Pay of a Government employee fixed in accordance with these rules shall not entitle his senior employee to get the benefit of his pay to be refixed under senior- junior pay fixation instructions issued from time to time. 

              (iii) During probation period, the Government employee shall not be get any arrears. After successful clearance of the probation and extension thereof, if any, arrear of the multiplier factor 2.25 and 2.59 shall be granted and the arrear of increase in pay with minimum 15% (fifteen percent) enhancement minus (-) increase in salary with factor 2.25 and 2.59 shall not be admissible: 

             Provided further that the employees recruited after 01.01.2016 and promoted before 20.09.2021 shall not have the option to switch over to the revised pay structure from the dated of his/her promotion" ; and 

(ii) sub-clause (v) shall be omitted. 

4. In the said rules, rule 7(III), shall be substituted as under:- 

"(III) The Government Employees recruited in the service from 15.01.2015 to 31.12.2015 (both days inclusive):- During probation period the Government employee shall be paid fixed emoluments in the unrevised pay scales/ DC Rates as he/she is/was getting as per the instructions dated 21.12.2015 issued by the Finance Department. His/her pay shall be fixed in the revised pay structure only after successful clearance of the probation period on the same analogy, as elaborated in Rule 7(II). The Government employee will not get any arrears of the probation period: 

            Provided that in case where a Government employee has been placed in higher pay scale between 01.01.2016 to 20.09.2021 on account of promotion, such Government employee shall have the option switch over to the revised pay structure from the date of his /her promotion: 

             Provided further that the Government employee who opts to switch over to the revised pay structure from the date of promotion, such Government employee shall be entitled to get the benefit of minimum increase of 15% (Basic pay+113% DA + minimum 15% increase) on the pay fixed on the promotional post. In these cases he/she shall have to forgo the claims of arrears during the period from 01.01.2016 till the date of promotion and arrear of minimum of increase of 15% shall also not admissible upto 20.09.2021: 

            Provided further that the Government employee who got more than one promotion during the period 01.01.2016 to 20.09.2021 has the option to switch over to the revised pay structure from the date of first promotion only. In these cases, the next annual increment shall accrue after completing the qualifying service of twelve months". 

5. In the said rules, in rule 7(V), the existing proviso shall be omitted. 

6. In the said rules, in rule 9, at the end, the following proviso shall be added:- 

            "Provided that the Government employees whose pay is fixed by giving the benefit of minimum increase of 15% as per notification no. 09/01/2021-5FP1/1228 dated 20.09.2021, shall only be paid arrear of revised pay fixed with the multiplier factor of 2.25/2.59. The arrears of increase in pay with minimum 15% (fifteen percent) increase minus(-) increase in pay with factor 2.25/2.59 shall not be admissible".

1.0 ਉਪਰੋਕਤ ਵਿਸ਼ਾ ਅੰਕਿਤ ਰੂਲਾਂ ਵਿੱਚ ਦਰਜ ਕਲਾਜ ਨੰ – 5 ਦੇ ਸਨਮੁੱਖ ਬਾਰਡਰ ਏਰੀਏ ਵਿੱਚ ਕੰਮ ਕਰਦੇ (ਟੀਚਿੰਗ ਅਤੇ ਨਾਨਟੀਚਿੰਗ) ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਵੱਲੋਂ ਇੱਕ ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦਾ ਲਾਭ ਲੈਣ ਲਈ ਮਾਨਯੋਗ ਕੋਰਟਾਂ ਵਿੱਚ ਵੱਖ-2 ਸਿਵਲ ਰਿੱਟ ਪਟੀਸ਼ਨਾਂ ਅਤੇ ਸਿਵਲ ਸੂਟ ਦਾਇਰ ਕੀਤੇ ਗਏ ਹਨ। ਵਿਸ਼ਾ ਅੰਕਿਤ ਰੂਲਾਂ ਵਿੱਚ ਦਰਜ ਕਲਾਜ ਨੰ - 5 ਦੀ ਟੂਕ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਹੈ - "Pay of members of the Service. The members of the Service shall be entitled to such scales of pay as may be authorized by the Department of Finance from time to time. The scales of pay, at present in force, are given in Appendix 'A'. However, the persons who shall join the service to become its members or who shall absorb in the Service by exercising or their option to opt it, shall be entitled to one addition increment in addition to their normal pay from date of joining or absorption in the Service, as the case may be. The members of Service shall further be entitled to one additional increment on their every promotion to higher post in addition to normal benefit of higher responsibility as a special incentive.

2.0 ਇਨਾਂ ਰੂਲਾਂ ਦੇ ਹਵਾਲੇ ਵਿੱਚ ਵਿਭਾਗ ਨੂੰ ਪ੍ਰਾਪਤ ਹੋ ਰਹੀ ਲਿਟੀਗੇਸ਼ਨ ਦੇ ਸਨਮੁੱਖ ਸਰਕਾਰ ਪੱਧਰ ਤੇ ਇਨਾਂ ਰੂਲਾਂ ਅਧੀਨ ਅਜਿਹੇ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਇੱਕ ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦਾ ਲਾਭ ਦੇੲ ਸਬੰਧੀ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਫੈਸਲਾ ਲਿਆ ਗਿਆ ਹੈ:- 

“ਕਿ ਬਾਰਡਰ ਏਰੀਆ ਵਿਚ ਤਾਇਨਾਤ ਕਰਮਚਾਰੀਆਂ/ਅਧਿਕਾਰੀਆਂ, ਜੇ ਸਰਕਾਰੀ ਸੇਵਾ ਵਿੱਚ ਇੱਕ ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦਾ ਲਾਭ ਲੈਣਾ ਚਾਹੁੰਦੇ ਹਨ ਕਿ ਉਹ ਆਪਏ ਸਬੰਧਤ ਜਿਲ੍ਹਾ ਸਿੱਖਿਆ ਅਫ਼ਸਰ (ਸੈ.ਸਿ.) ਨੂੰ ਆਪਈ ਆਪਸ਼ਨ ਦੇਣਗੇ ਕਿ ਉਹ ਸਾਰੀ ਸੇਵਾ ਦੇਰਾਨ ਬਾਰਡਰ ਏਰੀਆ ਵਿਚ ਤਾਇਨਾਤ ਰਹਿਣਗੇ ਜਾਂ ਨਹੀਂ। ਜੇਕਰ ਕੋਈ ਅਧਿਕਾਰੀ/ਕਰਮਚਾਰੀ ਬਾਰਡਰ ਏਰੀਆ ਤੋਂ ਨਾਨ ਬਾਰਡਰ ਏਰੀਆ ਵਿਚ ਤਾਇਨਾਤੀ ਲੈਂਦਾ ਹੈ, ਤਾਂ ਉਹ ਇਕ ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦੇ ਲਾਭ ਦਾ ਹੱਕਦਾਰ ਨਹੀ ਹੋਵੇਗਾ ।" 

3.0 ਉਕਤ ਅਨੁਸਾਰ ਸਰਕਾਰ ਵੱਲੋਂ ਲਏ ਗਏ ਫੈਸਲੇ ਸਬੰਧੀ ਆਪਣੇ ਅਧੀਨ ਕੰਮ ਕਰਦੇ (ਟੀਚਿੰਗ ਅਤੇ ਨਾਨਟੀਚਿੰਗ) ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਸੂਚਿਤ ਕੀਤਾ ਜਾਵੇ ਅਤੇ ਉਨ੍ਹਾਂ ਤੋਂ ਇਹ ਪੱਤਰ ਜਾਰੀ ਹੋਣ ਦੀ ਮਿਤੀ ਤੋਂ ਇੰਕ ਹਫਤੇ ਦੇ ਅੰਦਰ ਅੰਦਰ ਹਰ ਹਾਲਤ ਵਿੱਚ ਉਹਨਾਂ ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਤੋਂ ਨਾਲ ਨੱਥੀ ਅੰਡਰਟੇਕਿੰਗ ਅਨੁਸਾਰ ਆਪਸ਼ਨਾਂ ਦੇੲਗੇ ਕਿ ਜੇਕਰ ਉਹ ਬਾਰਡਰ ਏਰੀਏ ਵਿੱਚ ਹੀ ਆਪਈ ਸਾਰੀ ਸੇਵਾ ਨਿਭਾਉਣਗੇ ਤਾਂ ਹੀ ਉਹ ਬਾਰਡਰ ਏਰੀਆ ਦੇ ਰੂਲਾਂ ਅਨੁਸਾਰ ਇੱਕ ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦਾ ਲਾਭ ਲੈਣ ਦੇ ਹੱਕਦਾਰ ਹੋੲਗੇ।

4.0 ਜੇਕਰ ਕੋਈ ਵੀ ਅਧਿਕਾਰੀ/ਕਰਮਚਾਰੀ ਇੱਕ ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦਾ ਲਾਭ ਲੈੲ ਉਪਰੰਤ ਕਿਸੇ ਵੀ ਕਾਰਨ ਕਰਕੇ ਨਾਨ-ਬਾਰਡਰ ਏਰੀਏ ਵਿੱਚ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਉਹ, ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦਾ ਲਿਆ ਗਿਆ ਲਾਭ ਸਮੇਤ ਵਿਆਜ ਵਾਪਸ ਕਰਨ ਲਈ ਪਾਬੰਦ ਹੋਵੇਗਾ। 

5.0 ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਵੱਲੋਂ ਬਾਰਡਰ ਏਰੀਏ ਵਿੱਚ ਸਾਰੀ ਸੇਵਾ ਨਿਭਾਉੲ ਲਈ ਦਿੱਤੀ ਗਈ ਇਸ ਆਪਸ਼ਨ ਦਾ ਇੰਦਰਾਜ ਉਨ੍ਹਾਂ ਦੀ ਸੇਵਾਪੱਤਰੀ ਵਿੱਚ ਦਰਜ ਕੀਤਾ ਜਾਵੇ ਅਤੇ ਜਿਨ੍ਹਾਂ ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਵੱਲੋਂ ਇਹ ਆਪਸ਼ਨ ਦਿੱਤੀ ਜਾਵੇਗੀ, ਕੇਵਲ ਉਨ੍ਹਾਂ ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਦੀ ਲਿਸਟ ਜਿਲੇ ਵਾਇਜ ਤਿਆਰ ਕਰवे ਸਮੇਤ ਅੰਡਰਟੇਕਿੰਗ ਦੀ ਕਾਪੀ ਅਤੇ ਸੇਵਾਪੱਤਰੀ ਵਿੱਚ ਕੀਤੇ ਗਏ ਇੰਦਰਾਜ ਦੀ ਕਾਪੀ ਇਸ ਦਫਤਰ ਨੂੰ ਭੇਜੀ ਜਾਵੇ।

6.0 ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਰੂਲਾਂ ਅਨੁਸਾਰ ਇੱਕ ਵਾਧੂ ਇੰਨਕਰੀਮੈਂਟ ਦੀ ਆਪਸ਼ਨ ਦੇਣ ਸਬੰਧੀ ਕੋਈ ਹੋਰ ਮੌਕਾ ਨਹੀਂ ਦਿੱਤਾ ਜਾਵੇਗਾ ।

6th Punjab Pay Commission ਦੀਆਂ ਸਿਫਾਰਸ਼ਾਂ ਲਾਗੂ ਹੋਣ ਤੋਂ ਬਾਅਦ ਸਰਕਾਰੀ ਕਰਮਚਾਰੀਆਂ, ਜਿਨ੍ਹਾਂ ਦੀ Gross Pay (revised) ਪਹਿਲਾਂ ਮਿਲ ਰਹੀ Gross Pay (unrevised) ਨਾਲੋਂ ਘੱਟ ਹੈ, ਸਬੰਧੀ ਹਦਾਇਤਾਂ।

ਸਮੱਸਿਆ:

ਵਿੱਤ ਵਿਭਾਗ ਦੇ ਧਿਆਨ ਵਿੱਚ ਆਇਆ ਹੈ ਕਿ 6th Punjab Pay Commission ਦੀਆਂ ਸਿਫਾਰਸ਼ਾਂ ਲਾਗੂ ਹੋਣ ਤੋਂ ਬਾਅਦ, ਉਹ ਦਰਜ਼ਾ ਚਾਰ (Group 'D') ਕਰਮਚਾਰੀ ਜਿਨ੍ਹਾਂ ਦੀ ਪ੍ਰਮੋਸ਼ਨ 01.01.2016 ਤੋਂ ਬਾਅਦ ਦਰਜ਼ਾ ਤਿੰਨ (Group 'C') ਵਿੱਚ ਹੋਈ ਹੈ, ਨੂੰ Gross Pay (revised) ਪਹਿਲਾਂ ਮਿਲ ਰਹੀ Gross Pay (unrevised) ਨਾਲੋਂ ਘੱਟ ਮਿਲ ਰਹੀ ਹੈ।

ਸਰਕਾਰ ਦਾ ਫੈਸਲਾ:

ਸਰਕਾਰ ਨੇ ਫੈਸਲਾ ਲਿਆ ਹੈ ਕਿ ਅਜਿਹੇ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਉਨ੍ਹਾਂ ਦੀ ਪੁਰਾਣੀ Gross Pay (unrevised) ਪ੍ਰੋਟੈਕਟ ਕਰਦੇ ਹੋਏ ਉਦੋਂ ਤੱਕ ਅਦਾਇਗੀ ਕੀਤੀ ਜਾਂਦੀ ਰਹੇਗੀ, ਜਦੋਂ ਤੱਕ ਉਨ੍ਹਾਂ ਦੀ revised gross pay (6th PPC) ਪਹਿਲਾਂ ਪ੍ਰਾਪਤ ਕੀਤੀ ਜਾ ਰਹੀ unrevised Gross pay (5th PPC) ਨਾਲੋਂ ਵੱਧ ਨਹੀਂ ਜਾਂਦੀ।

ਅਦਾਇਗੀ ਦੀ ਮਿਤੀ:

ਇਹ ਅਦਾਇਗੀ ਉਸ ਮਿਤੀ ਤੋਂ ਕੀਤੀ ਜਾਵੇਗੀ ਜਿਸ ਮਿਤੀ ਤੋਂ ਸਬੰਧਤ ਕਰਮਚਾਰੀ ਨੂੰ Revised Gross Pay (6th PPC) ਦੀ ਘੱਟ ਅਦਾਇਗੀ ਹੋ ਰਹੀ ਹੈ।
ਪਾਲਣਾ:

ਪ੍ਰਬੰਧਕੀ ਵਿਭਾਗਾਂ ਵੱਲੋਂ ਇਹਨਾਂ ਹਦਾਇਤਾਂ ਦੀ ਇੰਨ ਬਿੰਨ ਪਾਲਣਾ ਯਕੀਨੀ ਬਣਾਈ ਜਾਵੇ।

ਇਹ ਹਦਾਇਤਾਂ ਭੇਜੀਆਂ ਗਈਆਂ ਹਨ:

  • ਵਿਸ਼ਾ: ਮੈਮੋ ਦਾ ਵਿਸ਼ਾ Ajit Singh Janjua-II Judgment ਮਿਤੀ 16.09.1999 'ਤੇ ਆਧਾਰਤ ਕੈਚ-ਅਪ ਰੂਲ ਸਬੰਧੀ ਹੈ.
  • ਪਿਛੋਕੜ: ਪ੍ਰਸੋਨਲ ਵਿਭਾਗ ਵੱਲੋਂ ਜਾਰੀ ਗਸ਼ਤੀ ਪੱਤਰ ਨੰ. 3/34/1999-3PP1/12565 ਮਿਤੀ 22.10.1999 ਰਾਹੀਂ ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਅਜੀਤ ਸਿੰਘ ਜੰਜੂਆ ਜੱਜਮੈਂਟ (I.A No. 1-3 in CWP No. 3792-3794 ਮਿਤੀ 16.09.1999) ਅਨੁਸਾਰ ਕੈਚ-ਅੱਪ ਰੂਲ ਦਾ ਸਿਧਾਂਤ ਲਾਗੂ ਕੀਤਾ ਗਿਆ ਹੈ.
  • ਸਮੱਸਿਆ: ਕਈ ਕੇਸਾਂ ਵਿੱਚ, ਰਿਜ਼ਰਵ ਵਰਗ ਦਾ ਜੂਨੀਅਰ ਕਰਮਚਾਰੀ ਰੋਸਟਰ ਪੁਆਇੰਟ 'ਤੇ ਪਹਿਲਾਂ ਪਦਉਨਤ ਹੋ ਜਾਂਦਾ ਹੈ. ਜਦੋਂ ਤੱਕ ਜਨਰਲ ਵਰਗ ਦਾ ਸੀਨੀਅਰ ਕਰਮਚਾਰੀ ਉਸ ਨੂੰ 'ਕੈਚ' ਕਰਦਾ ਹੈ, ਉਸ ਤੋਂ ਪਹਿਲਾਂ ਹੀ ਸਿੱਧੀ ਭਰਤੀ ਜਾਂ ਟਰਾਂਸਫਰ ਰਾਹੀਂ ਭਰਤੀ ਹੋਏ ਕਰਮਚਾਰੀ ਵਿਭਾਗ ਵਿੱਚ ਆ ਜਾਂਦੇ ਹਨ, ਜਿਸ ਨਾਲ ਕਰਮਚਾਰੀਆਂ ਦੀ ਆਪਸੀ ਸੀਨੀਆਰਤਾ ਫਿਕਸ ਕਰਨ ਵਿੱਚ ਦਿੱਕਤ ਆਉਂਦੀ ਹੈ.
  • ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਫੈਸਲਾ (16.09.1999): ਅਜੀਤ ਸਿੰਘ ਜੰਜੂਆ ਕੇਸ ਵਿੱਚ ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਹੈ ਕਿ:
    • ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰਾਂ ਦੁਆਰਾ ਦਿੱਤੀਆਂ ਗਈਆਂ ਉਦਾਹਰਣਾਂ ਨਾਲ ਕੋਈ ਅਸੰਗਤੀ ਪੈਦਾ ਨਹੀਂ ਹੁੰਦੀ ਹੈ.
    • ਜੇ ਇੱਕ ਸੀਨੀਅਰ ਜਨਰਲ ਉਮੀਦਵਾਰ ਨੂੰ ਰੋਸਟਰ ਪੁਆਇੰਟ ਪ੍ਰੋਮੋਟੀ (ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰ) ਤੋਂ ਬਾਅਦ ਪਦਉਨਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਅਤੇ ਉਸਨੂੰ ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰ ਤੋਂ ਉੱਪਰ ਰੱਖਿਆ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਉਸਦਾ ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰ ਦੇ ਵਿਰੁੱਧ 'ਕਾਨੂੰਨ ਵਿੱਚ, ਇੱਕ ਉੱਤਮ ਦਾਅਵਾ' ਹੈ.

  • ਹਦਾਇਤ: ਪੈਰ੍ਹਾ 2 ਵਿੱਚ ਦਰਜ ਸਥਿਤੀ ਵਿੱਚ ਸੀਨੀਆਰਤਾ ਨਿਰਧਾਰਤ ਕਰਨ ਲਈ ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਉਕਤ ਫੈਸਲੇ ਅਨੁਸਾਰ ਕਾਰਵਾਈ ਕੀਤੀ ਜਾਵੇ.
  • ਪਿਛਲੀ ਸਲਾਹ ਦੀ ਸਮਾਪਤੀ: ਜੇਕਰ ਪ੍ਰਸੋਨਲ ਵਿਭਾਗ ਵੱਲੋਂ ਪਹਿਲਾਂ ਉਕਤ ਦਰਜ ਫੈਸਲੇ ਤੋਂ ਕੋਈ ਵੱਖਰੀ ਸਲਾਹ ਜਾਰੀ ਕੀਤੀ ਗਈ ਹੋਵੇ ਤਾਂ ਉਸ ਸਲਾਹ ਨੂੰ ਰੱਦ ਸਮਝਿਆ ਜਾਵੇ.
  • ਪਾਲਣਾ: ਇਹਨਾਂ ਹਦਾਇਤਾਂ ਨੂੰ ਸਮੂਹ ਅਧਿਕਾਰੀਆਂ/ਕਰਮਚਾਰੀਆਂ ਦੇ ਧਿਆਨ ਵਿੱਚ ਇੰਨ-ਬਿੰਨ ਪਾਲਣਾ ਲਈ ਲਿਆਉਣਾ ਯਕੀਨੀ ਬਣਾਇਆ ਜਾਵੇ.
  • ਜਾਰੀ ਕਰਨ ਵਾਲਾ ਅਥਾਰਟੀ ਅਤੇ ਮਿਤੀ: ਪੰਜਾਬ ਸਰਕਾਰ, ਪ੍ਰਸੋਨਲ ਵਿਭਾਗ (ਪ੍ਰਸੋਨਲ ਪਾਲਿਸੀਜ਼-1 ਸ਼ਾਖ਼ਾ) ਵੱਲੋਂ ਮਿਤੀ 24/12/2025 ਨੂੰ ਜਾਰੀ ਕੀਤਾ ਗਿਆ.

ਦਿੱਕਤ ਉਦੋਂ ਆਉਂਦੀ ਹੈ ਜਦੋਂ ਰਿਜ਼ਰਵ ਵਰਗ ਦਾ ਜੂਨੀਅਰ ਕਰਮਚਾਰੀ ਰੋਸਟਰ ਪੁਆਇੰਟ 'ਤੇ ਪਹਿਲਾਂ ਪਦਉਨਤ ਹੋ ਜਾਂਦਾ ਹੈ ਅਤੇ ਜਦੋਂ ਤੱਕ ਜਨਰਲ ਵਰਗ ਦਾ ਸੀਨੀਅਰ ਕਰਮਚਾਰੀ ਉਸ ਨੂੰ 'ਕੈਚ' ਕਰਦਾ ਹੈ, ਉਸ ਤੋਂ ਪਹਿਲਾਂ ਹੀ ਵਿਭਾਗ ਵਿੱਚ ਉਸ ਕਾਡਰ ਦੀ ਸਿੱਧੀ ਭਰਤੀ ਜਾਂ ਟਰਾਂਸਫਰ ਰਾਹੀਂ ਭਰਤੀ ਹੋਏ ਕਰਮਚਾਰੀ ਆ ਜਾਂਦੇ ਹਨ।

ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਅਜੀਤ ਸਿੰਘ ਜੰਜੂਆ ਕੇਸ ਵਿੱਚ ਫੈਸਲੇ ਦੀ ਮਿਤੀ ਕੀ ਹੈ?  

ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਅਜੀਤ ਸਿੰਘ ਜੰਜੂਆ ਕੇਸ ਵਿੱਚ ਫੈਸਲੇ ਦੀ ਮਿਤੀ 16.09.1999 ਹੈ।

 Ajit Singh Janjua ਕੇਸ ਵਿੱਚ ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਫੈਸਲੇ ਅਨੁਸਾਰ ਸੀਨੀਅਰ ਜਨਰਲ ਉਮੀਦਵਾਰ ਦੇ ਹੱਕ ਵਿੱਚ ਕੀ ਕਿਹਾ ਗਿਆ ਹੈ ਜਦੋਂ ਉਹ ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰ ਤੋਂ ਬਾਅਦ ਪਦਉਨਤ ਹੁੰਦਾ ਹੈ?

ਮਾਨਯੋਗ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਕਿਹਾ ਕਿ ਜੇ ਇੱਕ ਸੀਨੀਅਰ ਜਨਰਲ ਉਮੀਦਵਾਰ ਨੂੰ ਰੋਸਟਰ ਪੁਆਇੰਟ ਪ੍ਰੋਮੋਟੀ (ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰ) ਤੋਂ ਬਾਅਦ ਪਦਉਨਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਅਤੇ ਉਸਨੂੰ ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰ ਤੋਂ ਉੱਪਰ ਰੱਖਿਆ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਉਸਦਾ ਰਿਜ਼ਰਵ ਉਮੀਦਵਾਰ ਦੇ ਵਿਰੁੱਧ "ਕਾਨੂੰਨ ਵਿੱਚ, ਇੱਕ ਉੱਤਮ ਦਾਅਵਾ" (superior claim, in law, against the reserved candidate) ਹੈ।

1(1)These rules may be called the Punjab Educational Service (School and Inspection) Group 'B' Service (Second Amendment) Rules, 2025.


(2) They shall come into force on and with effect from the date of their publication in the Official Gazette.

2. In the Punjab Educational Service (School and Inspection) Group B Service Rules, 2018 (hereinafter referred to as the said rules), in rule 2,-

(i) in clause (d), at the end, the word 'and' shall be omitted; and

(ii) in clause (e), at the end, for the sign".", the sign and word "; and" shall be substituted and thereafter, the following clause shall be added, namely:-

"(1) 'teacher' means Elementary Trained Teacher, Special Educator Teacher (Primary), Head Teacher. Centre Head Teacher, Art and Craft Teacher, Master/Mistress, Block Primary Education Officer, Vocational........................................."

No. 09/02/2021-5FP1/100.- In exercise of the powers conferred by the proviso to Article 309 read with clause (3) of Article 187 of the Constitution of India, and all other powers enabling him in this behalf, the Governor of Punjab, is pleased to make the following rules further to amend the Punjab Civil Services (Revised Pay)Rules, 2021, namely:- 

RULES 

1. (1) These rules may be called Punjab Civil Services (Revised Pay) Second Amendment, Rules, 2025. (2) They shall be deemed to have come into force on and with effect from the first day of January, 2016. 

2. In the Punjab Civil Services (Revised Pay) Rules, 2021(hereinafter referred to as the said rules), in rule 7(I), at the end, the following provisos shall be added, namely:- 

"Provided that in case where a Government employee has been placed in higher pay scale between 01.01.2016 to 20.09.2021 on account of promotion, such Government employee shall have the option to switch over to the revised pay structure from the date of his/her promotion: 

Provided further that the Government employee who opts to switch over to the revised pay structure from the date of promotion, such Government employee shall be entitled to get the benefit of minimum increase of 15% (Basic pay +113% DA + minimum 15% increase) on the pay fixed on the promotional post. In these cases, he/ she shall have to forgo the claims of arrears during the period from 01.01.2016 till the date of promotion and arrear of minimum increase of 15% shall also not admissible up to 20.09.2021:

Provided further that the Government employee who got more than one promotion during the period 01.01.2016 to 20.09.2021 has the option to switch over to the revised pay structure from the date of his first promotion only. In these cases, the next annual increment shall accrue after completing the qualifying service of twelve months"

3. In the said rules, in rule 7(II) in clause(c) sub-clause (iv) shall be substituted as under:- 

"(i) In case of the Government employees on whom instructions dated 15.01.2015 w.r.t. admissibility of Minimum of the Pay Band are applicable:- During probation period, the Government employee shall be paid fixed emoluments in the unrevised pay scales/ DC Rates as he/she is/was getting as per the instructions dated 21.12.2015 issued by the Department of Finance. His/her pay shall be fixed in the revised pay structure only after successful clearance of the probation period after applying the multiply factor(s). The Government employee will not get any arrears of the probation period: 

"Provided that the Punjab Civil Services (Revised Pay) First Amendment Rules, 2021 shall also be applicable to the Government employees recruited between 01.01.2016 to 16.07.2020, with the following conditions, namely:- 

(i) Pay of the Government employee recruited on or after 01.01.2016 and upto 16.07.2020 shall not, in any case, be more than his immediate senior Government employee in the cadre. If such a situation arises, then the pay of the junior employee shall be fixed at the same level as the senior. Wrong fixation of pay, in any case, under the cover of extending minimum 15% (fifteen percent) raise shall entail recovery from the salary of the concerned Government employee on its detection at any stage; 

(ii) Pay of a Government employee fixed in accordance with these rules shall not entitle his senior employee to get the benefit of his pay to be refixed under senior- junior pay fixation instructions issued from time to time. 

(iii) During probation period, the Government employee shall not be get any arrears. After successful clearance of the probation and extension thereof, if any, arrear of the multiplier factor 2.25 and 2.59 shall be granted and the arrear of increase in pay with minimum 15% (fifteen percent) enhancement minus (-) increase in salary with factor 2.25 and 2.59 shall not be admissible: 

Provided further that the employees recruited after 01.01.2016 and promoted before 20.09.2021 shall not have the option to switch over to the revised pay structure from the dated of his/her promotion" ; and 

(ii) sub-clause (v) shall be omitted. 

4. In the said rules, rule 7(III), shall be substituted as under:- 

"(III) The Government Employees recruited in the service from 15.01.2015 to 31.12.2015 (both days inclusive):- During probation period the Government employee shall be paid fixed emoluments in the unrevised pay scales/ DC Rates as he/she is/was getting as per the instructions dated 21.12.2015 issued by the Finance Department. His/her pay shall be fixed in the revised pay structure only after successful clearance of the probation period on the same analogy, as elaborated in Rule 7(II). The Government employee will not get any arrears of the probation period: 

Provided that in case where a Government employee has been placed in higher pay scale between 01.01.2016 to 20.09.2021 on account of promotion, such Government employee shall have the option switch over to the revised pay structure from the date of his /her promotion: 

Provided further that the Government employee who opts to switch over to the revised pay structure from the date of promotion, such Government employee shall be entitled to get the benefit of minimum increase of 15% (Basic pay+113% DA + minimum 15% increase) on the pay fixed on the promotional post. In these cases he/she shall have to forgo the claims of arrears during the period from 01.01.2016 till the date of promotion and arrear of minimum of increase of 15% shall also not admissible upto 20.09.2021: 

Provided further that the Government employee who got more than one promotion during the period 01.01.2016 to 20.09.2021 has the option to switch over to the revised pay structure from the date of first promotion only. In these cases, the next annual increment shall accrue after completing the qualifying service of twelve months". 

5. In the said rules, in rule 7(V), the existing proviso shall be omitted. 

6. In the said rules, in rule 9, at the end, the following proviso shall be added:- 

"Provided that the Government employees whose pay is fixed by giving the benefit of minimum increase of 15% as per notification no. 09/01/2021-5FP1/1228 dated 20.09.2021, shall only be paid arrear of revised pay fixed with the multiplier factor of 2.25/2.59. The arrears of increase in pay with minimum 15% (fifteen percent) increase minus(-) increase in pay with factor 2.25/2.59 shall not be admissible"

Delays in PRAN Generation and Final Settlement of Exit/Withdrawal Cases under NPS

In continuation of this office letter No. NPS/2021/1057 Dated 13-09-2021, regarding timelines prescribed for various activities under the New Pension Scheme (NPS), it has been observed that delays continue to occur in the following areas:

A. Registration of new subscribers and generation of PRAN, and
B. Initiation and authorization of final settlement (Exit/Withdrawal) cases under NPS.

2. These delays result in financial hardship for the concerned employees and are contrary to the instructions issued for timely execution of NPS processes.

3. All Heads of Departments, therefore, requested to:
A. Examine all cases where PRAN generation or final settlement under NPS was delayed, 

B. Identify the stage and cause of delay
C. Fix responsibility in such cases and take appropriate administrative or disciplinary action,

4. Further, it is requested to instruct all DDOs under your control to ensure strict adherence to the timelines already circulated vide this office letter No. NPS/2021/1057 dated 13.09.2021, so as to avoid recurrence of such delays.
